Terms & Conditions
Every advertiser and advertising agency who lodges an advertisement for publication (Advertiser) on the CareerOne website (www.careerone.com.au) (Website) operated by CareerOne Pty Ltd (Publisher) agrees to the following conditions.A. Advertising Conditions
| 1. | Publisher may at its absolute discretion refuse to publish any advertisement without giving any reason. In case of refusal, no charge to Advertiser shall be incurred. |
| 2. | Publisher may, under pressure of deadline and without prior consultation or notice to Advertiser, amend any advertisement in any terms whatsoever, if Publisher perceives the publication of the advertisement would be in breach of any relevant law, in breach of any pre-existing agreement of Publisher, in breach of any person’s rights or offensive. Should Publisher so amend the advertisement, the agreed price shall not be reduced. |
| 3. | The positioning or placement of an advertisement is at the discretion of Publisher except where expressly agreed in writing by Publisher. |
| 4. | Publisher is not liable to Advertiser for any loss of any nature arising from (a) the total failure of Publisher to publish an advertisement; or (b) the failure of Publisher to publish an advertisement in the form prescribed. This applies regardless of the cause of Publisher’s failure, including if Publisher was negligent or acted as permitted under these terms and conditions. In the case, of [a], the Advertiser will not have to pay any amount to Publisher under the booking form in relation to that specific failure of ad placement/publication. In the case of,(b), the amount payable under the booking form may be reduced according to circumstances. |
| 5. | If Publisher has quoted a rate to publish a specific quantity of advertising over a specific period and a lesser quantity is submitted for publication within that period, then what is published within that period shall be costed at whatever rate is necessary to generate the expenditure which would have been incurred had the full agreed volume been published. |
| 6. | Publisher may head an Advertisement, Advertisement, whenever required by law or whenever it considers it appropriate, for any reason, to distinguish it from other types of content. |
| 7. | Publisher has the right to amend these terms and conditions at any time. The most current Terms & Conditions of advertising are published on the Publishers website at www.careerone.com.au. |
| 8. | Publisher has no liability and Advertiser indemnifies Publisher in relation to any failure of telecommunications services or systems which affect the receipt by Publisher of an advertisement or the publication of a campaign. |
| 9. | Publisher makes no representation or warranty in relation to the number of visitors to its websites, the number of impressions on the website, or the number of applications Advertiser will receive from the website, except for any made expressly in writing by Publisher. |
| 10. | Advertiser accepts responsibility, and agrees to pay for all advertising services under this agreement, regardless of whether Advertiser fully utilises the services. |
| 11 | Each job listing posted on the CareerOne website must relate to a genuine job role and represent one unique listing. Publisher will assign each listing with a unique identifying code. Publisher has the right to remove any advertisements it believes are not unique or contain more than job role at its own discretion. Should publisher remove such jobs, the agreed price shall not be reduced. |
| 1. | Publisher may provide the Advertiser’s advertisement to any other party for publication on other websites (as determined by Publisher in its absolute discretion). Advertiser consents to such use and republication. |
| 1. | Payment for single job postings or multiple job packs must be made up front by credit card or electronic funds transfer. Advertiser’s request for this type of advertising on the Website will be activated on receipt of payment by Publisher. |
| 2. | All advertising agencies are subject to the News Limited “Commercial Credit Application For Accreditation Of An Advertising Agency” (“Accreditation”). If an agency does not comply with this Accreditation then the News Digital Media Credit application is applicable. The terms and conditions associated with these applications are available within the accreditation application. If applicable, advertising agencies which are subject to News Limited’s “Rules Governing Accreditation” will receive a commission discount of 10%. |
| 3. | Contract Advertisers may apply for credit terms with Publisher by completing a Credit Application Form, if requested by the Publisher. Publisher has the right to conduct a credit check of the Advertiser prior to accepting bookings specified in the Booking Form. |
| 4. | Invoices for all bookings will be issued and are payable at the commencement of the booking period. For Advertisers granted credit with the Publisher, payment terms are 30 days from date of invoice. Should any invoice become more than 14 days overdue Publisher can at its own discretion suspend access to the site until full payment is received. Should account access be suspended 100% of the contract amount will remain payable. Payments can be made by direct deposit, cheque or credit card. Accounts will not be activated until the credit application has been approved, or payment received for customers on transactions where pre payment is required. If payment is made by cheque, the account will not be activated until funds are cleared. |
| 5. | All rates and charges in the Booking Form are quoted exclusive of GST. Publisher will issue a valid tax invoice in relation to any supply of goods or services which is subject to GST. |
| 1. | Job postings are published for 28 days. Job Packs are valid for 6 months. Contracts are for a minimum 6 month period, or as specified in the booking form. |
| 2. | Cancellation of any advertisement or campaign must be received in writing no later than 21 days prior to the commencement of a campaign in order to receive a 100% refund. Any cancellations made after this time will be subject to a minimum cancellation fee of 100% of the total cost of the entire campaign. Campaigns cancelled at the request of the Advertiser after the campaign has commenced will not be entitled to a refund of any unused portion of the campaign. |
| 3. | The booking form for Job Listings is valid for 72 hours from the time it is provided to Advertiser. Publisher cannot guarantee the order is fulfilled unless a signed copy of the booking form is received within that timeframe. Display advertising can not be reserved and all bookings are subject to availability at the time of receiving the signed booking form. |
| 4. | The pricing on the booking form is based on the anticipated advertising volume advised to Publisher by the Advertiser. Should actual advertising volumes exceed the specified advertising limit in any given month during the agreement, the Publisher will charge Advertiser at the relevant per job price, for all jobs exceeding the specified limit. |
| 5. | At the expiry of the term of this agreement, you must notify Publisher in writing of your intention to discontinue advertising with Publisher 14 days prior to the expiry of the term of this agreement. If you continue to use Publishers services beyond the expiry of the term of this agreement, Publisher will invoice you at the rates indicated on the most recent CareerOne published Rate Card. |
| 6. | If Advertiser utilises Specialist Tile Bookings, and wishes to renew their position for the month after expiry of the contract, the current contract must be renewed 30 days prior to the end of the previous contract. If the request to renew the booking is not received 30 days prior to the end of the contract, the following month will be opened to the first booking received. |
| 7. | CareerOne Resume database can only be purchased by Advertisers who are current Careerone job listing Advertisers. |
| 8. | If Advertiser purchases CareerOne Resume Database, access to the database is restricted to the one nominated representative. Access password is not to be shared among employees. Should you require additional licences, these can be purchased through your CareerOne Customer Service Representative |
| 9. | Resumes downloaded from the CareerOne Resume Database are not to be used for any purpose other than reviewing candidates for potential employment opportunities, and should not be viewed, shared or passed onto anyone other than employees of the Advertiser. The Advertiser must comply with all legal requirements in relation to the use, collection and storage of personal information. |
| 10. | The terms of this and any other agreement between Publisher and Advertiser must remain confidential. |
| 1. | Standard creative must be received no later than 3 working days prior to the campaign start date. Rich media creative must be received no later than 5 working days prior to the campaign start date. |
| 2. | If creative is received after the relevant date and results in a campaign being delayed, the publication of the advertisement will be considered to have commenced as of the date on the Booking Form. |
| 3. | All click-through URL’s must enable the browser’s back feature to allow users to return to Publisher’s website. |
| 1. | By lodging material including electronic material or data for publication or authorising or approving the publication of any material with the Publisher, Advertiser warrants that the material complies with all relevant laws and regulations and that its publication will not give rise to any claims or liabilities in Publisher, its directors, employees or agents. |
| 2. | Without limiting the generality of the above, Advertiser warrants that nothing in the material lodged for publication breaches the Trade Practices Act 1974, Copyright Act 1968, Fair Trading Act 1987, defamation, consumer protection and sale of goods legislation of the States and Territories or infringes the rights of any person. |
| 3. | By lodging material including electronic material or data for publication or authorising or approving the publication of any material with the Publisher, Advertiser indemnifies Publisher and its directors, employees and agents against all claims, demands, proceedings and other liability arising wholly or partially, directly or indirectly, from the publication of the material. |
| 4. | Without limiting the generality of the above, Advertiser indemnifies Publisher and its directors, employees and agents against any claims arising from (a) defamation, libel, slander of title; (b) infringement of copyright; (c) infringement of trade marks or names of publications titles; (d) unfair competition; (e) breach of trade practices or fair trading legislation; and (f) violation of rights of privacy or confidential information or licenses or royalty rights or other intellectual property rights. |
| 1. | Publisher collects your personal information to assist Publisher in providing the goods or services Advertiser has requested and to improve Publisher's products and services. Publisher, or any of its Australian related companies may be in touch to let Advertiser know about goods, services or promotions which may be of interest to Advertiser. Publisher may also share information with other persons or entities who assist us in providing our services. Publisher is part of a global media and entertainment company and would like to share your information with these overseas related companies so that they can contact you with offers. If you would prefer Publisher not to share information, please write to our privacy officer at Privacy Officer, News Digital Media, privacy@news.com.au, (02) 9288 3000, Level 3, 2 Holt Street. Advertiser can gain access to its personal information by contacting Publisher's privacy officer. |
